Terms and Conditions of the Online Store

These Terms and Conditions set out the rules for using the online store.

 

§1 Preliminary Provisions

1.       These Terms and Conditions (“Terms”) set forth the rules for using the online store (“Store”) operated at the URL https://koraba.eu, or at addresses that are its extensions or continuations, by:

o    Company name: Marespol Sp. z o.o. (“MARESPOL”)

2.       Use of the Store is conditional upon prior acceptance of these Terms and compliance with the rules contained herein. Users are advised to read the Terms before taking any action.

3.       All information regarding the Store and related matters can be obtained:

o    At the MARESPOL headquarters indicated in section 2 of this paragraph

§2 Ordering

1.       Products offered in the Store may be purchased in the following manner:

o    By placing an order for the selected product(s) directly in the Store, resulting in the conclusion of a distance contract and an obligation to pay for the ordered product(s)

2.       Buyers making transactions in the Store are advised to fill in all fields in the order or reservation form accurately and truthfully to avoid any irregularities in the ordering process.

3.       For orders placed as described in section 1.1 of this paragraph:

o    By placing an order that results in an obligation to pay, the buyer may make payment using one of the methods described in §3 of the Terms

o    If the buyer selects the payment methods referred to in §3 sections 1.1 and 1.2, the order will be processed and shipped after payment is received

o    Orders placed on weekdays after 3:00 p.m., on Saturdays, Sundays, or public holidays will begin to be processed on the next business day

o    The usual order processing time, counted from the date of contract conclusion to the date the product is handed over to the buyer, is up to 5 business days; the applicable processing time for a given order will be provided to the buyer before the order is placed

§3 Payments

1.       Payment by the buyer for the contract concluded in the Store as described in §2 section 1a of the Terms may be made in the following forms:

o    Bank transfer to the MARESPOL account: bank, account number: {0000}

o    Electronic payment via Shopify Payments

§4 Liability for Physical and Legal Defects

1.       Products offered in the Store are new and free from physical or legal defects.

2.       MARESPOL is liable to the buyer for physical and legal defects of products purchased via the Store (“Statutory Warranty”) if such defects are discovered within two years from the date the product is delivered to the buyer.

3.       If a defect is discovered, the buyer must report it no later than one year from the end of the Statutory Warranty period.

4.       Claims under the Statutory Warranty may be submitted by:

o    By completing the contact form at https://koraba.eu

o    At the MARESPOL headquarters indicated in section 1b of this paragraph

5.       All claims under the Statutory Warranty will be considered by MARESPOL within 14 days from the date of submission.

6.       In the event of a defect, the buyer may:

o    Submit a statement requesting a price reduction

o    Withdraw from the contract

o    Request replacement of the defective product with a new one

o    Request repair of the product

7.       The rights described in sections 6.1 and 6.2 of this paragraph do not apply if MARESPOL immediately and without undue inconvenience repairs the defective product or replaces it with a new, defect-free product. This limitation does not apply if the product has already been replaced or repaired, unless bringing the product into conformity with the contract in the manner chosen by the buyer would involve excessive costs or be impossible.

8.       For the quickest possible processing of defective product claims, it is recommended to provide a precise and detailed description of the defect, in particular using the sample form attached as Appendix 2 to the Terms.

9.       If it is found that the non-conformity of the product with the contract is due to reasons attributable to the buyer, including improper use, MARESPOL will contact the buyer to inform them of any repair costs.

10.  In addition, selected products offered by MARESPOL are covered by a guarantee:

o    The terms of the guarantee, product description, and method of providing the guarantee service are specified in the guarantee card attached to the product

o    The inclusion of a product under guarantee does not exclude, limit, or suspend the buyer’s rights under the Statutory Warranty

§5 Withdrawal from the Contract

1.       In accordance with Article 27 of the Consumer Rights Act, a buyer who is a consumer and purchases through the Store as described in §2 section 1.1 of the Terms has the right to withdraw from the contract concluded with MARESPOL.

2.       Withdrawal from the contract is effected by submitting a statement; it is recommended to use the template provided in Appendix 1 to the Terms.

3.       Withdrawal from the contract may be made within a non-extendable period of 14 days from the date the buyer or a third party indicated by the buyer, other than the carrier, takes possession of the product.

4.       The withdrawing party must return the delivered product immediately, but no later than 14 days from the date of withdrawal. The product should be sent to: MARESPOL Online Store, Mikołaja Kopernika 60G/2, 81-411 Gdynia, Poland

5.       The buyer is not entitled to withdraw from a contract where the subject of the contract is a product made to individual order or closely related to the buyer’s person.

6.       The buyer is liable for any diminished value of the product resulting from use beyond what is necessary to establish its nature, characteristics, or functioning.

§6 Copyright

1.       The Store, together with all its integral elements, in particular layouts, software, or databases, constitutes a collective work within the meaning of Article 11 of the Act of 4 February 1994 on Copyright and Related Rights, of which MARESPOL is the editor. The above does not include proprietary copyrights to works posted on the Service by its users.

2.       It is prohibited to distribute, record, reproduce, archive by digital means, or introduce to computer memory, or to create derivative works of the Store, including use of its fragments or elements, without the knowledge and consent of MARESPOL.

§7 Final Provisions

1.       In the event of changes to the Terms by MARESPOL, the Store user has the right, within 14 days from learning of the changes, to submit a statement to shop@koraba.eu objecting to the application of the amended Terms to them, which will be tantamount to termination of the legal relationship underlying the services referred to in the Terms.

2.       The above does not apply to obligations entered into before the statement referred to in the preceding point is made, which will be performed on the previously applicable terms, unless the user requests that the amended Terms apply to the relevant obligation.
